General Provisions
1.1. This Agreement is an official offer (public offer) from Individual Entrepreneur Luiza Menyailova trading as “Zayac Meхovoi” store (hereinafter referred to as the “Executor”) to a fully capable natural person (hereinafter referred to as the “Customer”), who accepts this offer under the specified conditions.
1.2. In accordance with Article 437 Clause 2 of the Civil Code of the Russian Federation (Civil Code of the RF), upon acceptance of the conditions stated below and payment for services, the legal or natural person accepting this offer becomes the Customer (in accordance with Article 438 Clause 3 of the Civil Code of the RF, acceptance of the offer is equivalent to concluding a contract on the terms set forth in the offer).
1.3. The moment of full and unconditional acceptance of the Executor’s offer by the Customer to conclude a contract (acceptance of the offer) is considered the confirmation of readiness to pay for the Executor’s service by pressing the “Pay” button on the website https://zayacmehovoi.com. 1.4. By accepting the Contract in accordance with clause 1.3 of the Contract, the Customer confirms that they have read, agreed to, fully and unconditionally accepted all the terms of the Contract as they are set forth in the text of the Contract, including its appendices that are an integral part of the Contract.
1.5. The Customer agrees that acceptance of the Contract under the terms specified in clause 1.2 of the Contract constitutes the conclusion of the Contract on the terms set forth therein.
1.6. The Contract cannot be revoked.
1.7. The Contract does not require sealing with stamps and/or signing by the Customer and the Executor (hereinafter referred to as the “Parties”) and retains legal force.
Subject Matter of the Contract
2.1. The subject matter of this Contract is the paid provision of educational services by the Executor in accordance with the terms of this Contract.
2.2. The Customer fully accepts the terms of the Contract and pays for the Executor’s services in accordance with the terms of this Contract.
Payment for Services
3.1. The cost of services under the Contract is determined in accordance with the current prices and is specified on the website https://zayacmehovoi.com. (https://zayacmehovoi.com/)
3.2. The cost of the service may be changed by the Executor unilaterally.
3.3. Methods of payment for the service are specified during payment processing.
Intellectual Property
4.1. All textual information and graphical images located on the website https://zayacmehovoi.com (https://zayacmehovoi.com/) are the property of the Executor.
Special Terms and Liability of the Parties
5.1. The Executor is responsible for the timely provision of services when the Customer complies with the established requirements and rules posted on the website https://zayacmehovoi.com. (https://zayacmehovoi.com/)
5.2. The Executor is released from liability for the breach of the Contract terms if such breach is caused by force majeure circumstances, including but not limited to: actions of state authorities, fire, flood, earthquake, other natural disasters, lack of electricity, strikes, civil unrest, riots, and any other circumstances beyond the Executor’s control that may affect the performance of the Contract.
5.3. The Executor is not responsible for the quality of public communication channels or services providing the Customer with access to their services.
Confidentiality and Personal Data Protection
6.1. The Executor undertakes not to disclose information received from the Customer.
6.2. Disclosure of information in accordance with justified and applicable legal requirements is not considered a breach of obligations.
6.3. The Executor collects information about the IP address of the visitor to the website https://zayacmehovoi.com. (https://zayacmehovoi.com/) This information is not used to identify the visitor’s identity.
6.4. The Executor is not responsible for information provided by the Customer on the website https://zayacmehovoi.com (https://zayacmehovoi.com/) in publicly accessible form.
Procedure for Handling Claims and Disputes
7.1. Claims from the Customer regarding the services provided are accepted by the Executor for consideration via email within 2 (business) days from the moment the disputed situation arises.
7.2. When considering disputed situations, the Executor has the right to request from the Customer all relevant documentation regarding the event under review. If the Customer fails to provide the documents within 1 business day after the request, the claim will not be considered by the Executor.
7.3. The Executor and the Customer, taking into account the nature of the service provided, undertake to apply pre-trial dispute resolution procedures in case of disputes and disagreements related to the provision of services. In case of impossibility to resolve the dispute in an out-of-court procedure, the parties have the right to apply to court.
Other Terms
8.1. The Customer has all rights and powers necessary to enter into and perform the Contract.
8.2. The Customer has the right to unilaterally refuse the Executor’s services at any time. In case of unilateral refusal by the Customer from the Executor’s services, the payment made is not refunded but can be transferred to another service.
8.3. The Executor reserves the right to change or amend any of the terms of this Contract at any time by publishing all changes on their website.
8.4. For all matters not regulated by this Contract, the parties shall be guided by the current legislation of the Russian Federation.
8.5. Recognition by a court of law of the invalidity of any provision of this Contract and rules does not entail invalidity of the remaining provisions.
